1. Service Overview
Luma Audit is an automated web accessibility scanning platform that provides:
• Automated WCAG 2.1 Level AA accessibility scanning of practice websites
• ADA Exposure Assessments — dated PDF records of your website's accessibility status at the time of scan
• Compliance scoring and violation reporting
• Benchmark comparisons against similar practice types
• Actionable remediation guidance for your web developer or marketing agency
The Service is designed to help dental and healthcare practice owners understand their current accessibility posture and generate documented evidence of good-faith compliance efforts.
2. This Is Not Legal Advice — Important
Luma Audit provides automated technical assessments, not legal advice or legal protection.
A Luma Audit ADA Exposure Assessment is a dated record of an automated WCAG 2.1 AA scan of your website. It documents violations detected by automated testing tools at a specific point in time.
This assessment:
• Is NOT a legal opinion
• Does NOT constitute a certification of ADA compliance or non-compliance
• Does NOT guarantee protection against legal action, demand letters, or lawsuits
• Does NOT create an attorney-client relationship between you and Luma Audit
Having a documented, dated accessibility scan on file may support a good-faith defense if you ever receive an ADA demand letter — but Luma Audit makes no warranty or representation that this is the case. You should consult a qualified ADA attorney for legal advice specific to your situation and jurisdiction.
3. Accuracy and Limitations of Automated Scanning
Luma Audit uses automated scanning tools — including axe-core and Playwright — to identify accessibility violations and generate remediation guidance.
Automated testing tools can reliably detect approximately 30–40% of WCAG 2.1 AA conformance issues. This includes missing alt text, insufficient color contrast, missing form labels, incorrect ARIA attributes, and structural markup issues.
The remaining 60–70% of WCAG conformance requires human judgment — whether alt text accurately describes image content, whether content is written in plain language, whether focus management works correctly in complex interactions, and whether video captions are accurate.
While we strive for accuracy, automated tools cannot detect all accessibility issues. Luma Audit does not guarantee that:
• All violations on your website have been detected
• Implementing suggested remediations will result in full legal or regulatory compliance
• A passing score or low violation count means your site is legally compliant with the ADA or any other law
4. Your Responsibility
Luma Audit provides findings and recommendations. You are responsible for:
• Reviewing suggested remediation guidance before implementing it
• Working with qualified developers to test and implement fixes
• Maintaining ongoing accessibility as your site evolves — new content, plugins, or design updates may introduce new violations
• Consulting a qualified ADA attorney for legal advice about your specific compliance obligations
Compliance outcomes depend on actual implementation. An ADA Exposure Assessment report from Luma Audit does not constitute legal advice and does not substitute for legal counsel.
5. Permitted Use
You may use Luma Audit to scan websites that you own, operate, or have been explicitly authorized to scan.
You may not use the Service to:
• Scan websites without authorization from the website owner
• Attempt to disrupt, overload, or abuse the scanning infrastructure
• Resell scan results without a valid Agency plan
• Use automated tools to bulk-scan domains without prior agreement with Luma Audit
We reserve the right to suspend or terminate accounts that violate these terms.
6. Account Access
Free scans may require only an email address. Paid plans require account registration.
You are responsible for maintaining the security of your account credentials. Luma Audit is not liable for unauthorized access resulting from compromised credentials.
You may request account deletion at any time by contacting us at support@lumaaudit.com.
7. Billing and Cancellations
Paid plans are recurring monthly subscriptions. You will be billed on the same date each month.
You can cancel at any time. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer prorated refunds for partial months.
Prices are listed in USD. We reserve the right to adjust pricing with 30 days' notice to existing subscribers.
8. Intellectual Property
All content, code, and design of the Luma Audit platform are the intellectual property of Luma Audit.
ADA Exposure Assessment reports and remediation guidance produced for your websites are yours to use and retain. You may share them with your attorney, developer, marketing agency, or insurer. You retain full rights to implement suggested code fixes within your own projects.
You may not reproduce, redistribute, or resell the Luma Audit platform, its interface, or its underlying technology.
9. Limitation of Liability
Luma Audit is provided "as is" without warranties of any kind, express or implied.
To the maximum extent permitted by law, Luma Audit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Loss of revenue, business, or opportunity
• Legal fees, settlements, or judgments in ADA-related actions
• Failure to detect accessibility violations on your website
• Reliance on scan results without independent legal counsel
Our total liability for any claim arising from the use of the Service is limited to the amount you paid to Luma Audit in the 12 months preceding the claim.
